Any use of this website or its contents - including copying, storage, modification and redistribution - other than for your own personal, non-commercial use, is strictly prohibited without our prior written permission.

Accuracy of content

We strive for accuracy and fairness in the content of our website, product descriptions and quoted prices.
All prices are shown inclusive of VAT.
Any weights, dimensions and amounts of data given about the products are approximate only.
To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. We cannot be held liable for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

User Accounts

While it is perfectly possible to browse our website anonymously, it is necessary to create a user account on FXpansion.com in order to purchase and register products. An account is also necessary in order to access technical support as well as to obtain certain free products and demos.
A user account contains a number of personal details which are used to identify you and your ownership of software licenses for purchased and free products. Your details may also be used for our own market analysis to enable us to improve our products and services but we guarantee that we will not resell or redistribute these details or results of any market analysis to any third party individual or organisation.
We are registered under the Data Protection Act 1988 and comply with the Act fully in regards to your personal data.
No payment details are stored on our systems - all transactions are handled via the Paypal payment processing system. It is not necessary to possess a Paypal account in order to purchase products from us although Paypal account holders will experience a faster checkout process.
By creating a user account on our website you must ensure that:

• all information you submit is accurate and truthful
• you keep this information accurate and up-to-date
• you have permission to submit payment information if purchasing a product

Your FXpansion user account is registered to a single user only - it is prohibited to share your account login details with a third party. If you use a shared computer, please do not save your account login details in your internet browser or in any other location within the shared computer.
FXpansion cannot be held liable for any losses or damages that result from your account details being shared by you.
FXpansion reserves the right to close user accounts it considers to be fraudulent.
If you have reason to believe that your user account login details have been obtained by another party without your consent, please contact us immediately on info@fxpansion.com to suspend your account and cancel any unauthorised purchases that may be pending. Please be aware that purchases can only be cancelled before they are dispatched.
If you need to terminate your account for any other reason, please contact us.

Forum Access

Registering a user account on this website also enables access to the FXpansion user forum which is intended to be used for discussing technical issues and for users to help other users. Any use of the forum must comply with the following criteria:

• You will not post any messages that are obscene, vulgar, sexually-oriented, hateful, threatening, or otherwise violative of any laws
• You will not post needlessly antagonistic messages or personal attacks on any other user of the forum
• Your contributions will abide by the intended uses of the forum as outlined above, within reason

All content within the forum represents the views of its individual author(s) - FXpansion cannot be held responsible for the content of any message.
FXpansion reserves the right to remove, edit, move or close any forum message or message thread for any reason without explanation.

Your contact details will only be used by FXpansion Audio UK Ltd to supply you with information concerning its products, updates and special offers from time to time
All mailings are completely optional and can be activated or deactivated at any time.
We will not resell or redistribute your email address or any other personal details to any other third party individual or organisation.

Cookies and tracking

We use a limited number of cookies on our site in order to bring the best possible service to our customers and to remember user login details of the main site and forum. We use Google Analytics to anonymously observe on-line traffic so that we can improve the navigation and content within our site.
In all these cases, no information is shared with any third party individual or organisation.

Security

We take security extremely seriously and endeavour to do everything possible to protect your personal information. However the security of any data disclosed online cannot be guaranteed and we cannot be held liable for any breach of security.
We highly recommend that you use a unique password for your FXpansion user account - please do not reuse passwords that are used for other internet logins. Doing so may place your user account and product investments at risk if your other internet logins are compromised.
All payment procedures operate with a secure http connection (https) and are handled entirely by our payment processing system (Paypal). No user payment details are held on our servers.

Delivery charges

Online shop orders excluding North American orders are processed by our distribution team in London. North American orders are processed by our US office and shipped via UPS.
Orders to the rest of the world are dispatched via various carriers. The shipping fee depends on your geographic location and the products ordered. Please select your region (USA / UK / EU / Rest of world) and add the desired product(s) to the shopping basket - the shipping fee is calculated automatically for your region.
After submitting your order, you'll receive an automatic confirmation email with your order details. Sensitive data such as credit card numbers will not be sent via email for security reasons.

Returns and refunds policy

All sales within the EU are subject to the Consumer Rights Act 2015.
You may return most unopened boxed items you have purchased from the FXpansion.com web shop within 30 days of delivery for a full product refund - as long as the product is unopened.
Boxed software products that have been opened and are found to be defective may be exchanged for a replacement item of the same title and platform only.
Please contact our support team for a return delivery address.
We reserve the right to refuse returns/refunds on opened boxed products.
Orders for digital download products can be cancelled within 14 days of purchase if they have not been downloaded. Orders that have been downloaded are non-refundable unless there is a fault or system incompatibility that cannot be remedied.
Refunds are generally only issued in cases where technical issues that are impossible to overcome after technical support has been provided. FXpansion reserves the right to refuse to refund any purchase on a case-by-case basis.
Some of our products are available in third party retail stores and dealers - FXpansion is unable to offer any return, refund or exchange policy on these purchases. In such cases please contact the relevant dealer if you require assistance.

License & Registration Transfers

For most products, transferral of software license ownership can be granted with an accompanying fee per user - if transferring multiple products to a single new license owner, a single fee can be paid. After this procedure, the new license owner is entitled to the same support, updates and upgrades as a user that purchased a new product.
In all cases, permission to proceed with the transfer must first be granted by our support team. We reserve the right to refuse license transfers on a case-by-case basis. NFR (Not For Resale) products cannot be transferred to another user.
Certain soundware products which have a very low price cannot be transferred to another user - please see the FAQ for each product to confirm its license transfer policy.

Damages or losses incurred to your computer

We are not liable for any loss or damage which may arise as a result of using this website. We endeavour to ensure that all materials on this website are free from defects or viruses although this cannot be guaranteed. It is the user's responsibility to ensure that their computer equipment is adequately protected.

Law, jurisdiction and exclusion of liability

This website, its included content and any use of the software distributed within it are subject to English law and the jurisdiction of the courts of England. Any use of these materials recognises this fact.
Any disclaimers within these terms and conditions are subject to English law. If any of the provisions within these disclaimers are deemed to be unlawful and/or unenforceable, then those provisions are severable while not affecting the validity and enforceability of the remaining provisions.

These terms and conditions are subject to review and FXpansion reserves the right to change them periodically.
